Welcome to Sea Kids (“we”, “us”, “our”). These Terms & Conditions (“Terms”) outline how you may use our website, www.seakidsswimwear.com (“Site”), and purchase our products.
By using this Site or placing an order, you agree to these Terms, our Privacy Policy, and any other policies referred to here. Please read them carefully.
1. About Sea Kids
Sea Kids is a New Zealand-owned and operated business.
All prices on this Site are shown in New Zealand Dollars (NZD) unless stated otherwise.

2. Using Our Site
You agree to use the Site lawfully and in a way that does not harm Sea Kids, our customers, or others. You must not:
- Interfere with or disrupt the Site’s operation or security.
- Copy, reproduce, or distribute Site content without permission.
- Use the Site for fraudulent or unlawful activity.
We may suspend or terminate your access if you breach these Terms.
3. Changes to the Site or Terms
We may update these Terms, our products, or prices at any time without notice.
The version posted at the time of your order applies to that transaction.
Significant changes will update the “Last Updated” date above.
4. Product Information & Availability
We make every effort to ensure product descriptions, images, and prices are accurate and up to date.
However, minor variations in colour, print placement, and brightness may occur between what you see online and the actual garment.
This can happen due to:
- Differences in screen settings, brightness, or resolution on your device;
- Natural variations that occur during fabric printing and production; or
- Lighting conditions during photography.
We do our best to represent products as accurately as possible, but we cannot guarantee that the colours displayed on your screen exactly reflect the item you receive.
We reserve the right to correct errors, limit purchase quantities, or discontinue products at any time.
5. Orders & Payment
5.1 Placing Orders
When you place an order, you are making an offer to purchase products under these Terms.
A binding agreement forms once we confirm your order via email.
5.2 Payment & Currency
All transactions on this Site are processed in New Zealand Dollars (NZD).
Prices displayed in other currencies (such as Australian Dollars (AUD)) are shown for convenience only and are based on current exchange rates.
Even if you choose to view prices in AUD, your payment will still be charged in NZD at checkout.
Your bank or payment provider will convert the NZD amount to your local currency and may apply their own exchange rate or fees.
Sea Kids is not responsible for any difference between displayed conversions and the amount charged by your bank.
All prices include GST (Goods and Services Tax) where applicable.
Orders will not be dispatched until full payment is received.
We reserve the right to cancel and refund any order affected by pricing or stock errors.
6. Shipping & Delivery
We deliver throughout New Zealand and selected international destinations.
Delivery timeframes shown at checkout are estimates only.
Risk passes to you upon delivery to the address provided; ownership passes once payment is received in full.
Sea Kids is not responsible for postal or courier delays, customs processing, or other external factors.
7. Returns, Exchanges & Refunds
We want you to love your Sea Kids swimwear!

In summary:
- Items must be returned within 14 days of receipt.
- Items must be unworn, unwashed, and in original condition with all tags and hygiene stickers intact.
- Swimwear must be tried on over underwear for hygiene.
- We offer store credit or exchange only, unless the item is faulty.
- Refunds are available only for faulty items under the Consumer Guarantees Act 1993 (CGA).
- Return shipping costs are your responsibility unless the item is faulty or incorrect.

8. Faulty Items
If your product is faulty, please contact us with details and photos.
Under the CGA, you’re entitled to a repair, replacement, or refund for products that are faulty, unsafe, or not fit for purpose.
Sea Kids fully complies with the CGA and Fair Trading Act 1986 (FTA).
9. Promotions, Discounts & Gift Cards
- Discounts or promo codes must be entered at checkout and can’t be applied afterward.
- Only one discount code per order.
- Gift cards are valid for 12 months from purchase and can’t be redeemed for cash.
- Sale items are final unless faulty under the CGA.
10. Intellectual Property
All text, images, graphics, logos, and designs on this Site are owned or licensed by Sea Kids and protected by New Zealand copyright and trademark laws.
You may not copy, modify, or reuse any content without written permission.
11. Limitation of Liability
To the fullest extent permitted by law:
- Sea Kids is not liable for any indirect, incidental, or consequential loss from using this Site or our products.
- Our total liability (whether in contract, tort, or otherwise) will not exceed the price paid for the relevant product.
- Nothing in these Terms affects your rights under the Consumer Guarantees Act 1993.
12. Privacy & Data
Your personal information is handled according to our Privacy Policy, compliant with the New Zealand Privacy Act 2020.
We take care to store data securely and use it only to process orders, manage your account, or communicate with you.
13. User-Generated Content
By tagging @seakidsswimwear or submitting photos, reviews, or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use that content in our marketing, website, and social media.
You confirm you own the content and that it doesn’t infringe anyone’s rights.
14. Governing Law
These Terms are governed by the laws of New Zealand, and any disputes will be resolved in the courts of New Zealand.
